Terms of Service

1.Introduction#

Vi3W is an AI-powered 3D generation platform. It is operated by Vi3W, based in Pune, Maharashtra, India (“Vi3W”, “we”, “us” or “our”).

These Terms of Service (the “Terms”) apply when you visit our website at https://vi3w.in, use our web application at https://app.vi3w.in, or use any other service we offer that links to these Terms (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

These Terms work together with the following policies, which are part of them:

• Privacy Policy: how we handle personal data.
• Refund & Cancellation Policy: billing, cancellation and refunds.
• Acceptable Use Policy: what you may and may not do with Vi3W.
• Content & Intellectual Property Policy: who owns what.
• Cookie Policy: cookies and similar technologies.

2.Definitions#

• Account: your registered Vi3W account.
• Inputs: anything you submit to the Service, including text prompts, images, sketches and other files.
• Outputs or Generated Models: 3D models and other results the Service produces from your Inputs.
• User Content: your Inputs, your Outputs, and the projects you create and store in the Service.
• Credits: units of entitlement that you spend to use certain features, such as generating a model.
• Plan or Subscription: a free or paid plan that sets your price, billing period, Credit allowance and limits.
• Third-Party Services: services operated by other companies that we use to run Vi3W, such as authentication, hosting, AI model processing, analytics and payments.

3.Eligibility#

You must be at least 13 years old to create an Account or use the Service. By using Vi3W you confirm that you meet this requirement.

If you are under 18 (or under the age of majority where you live), you may use Vi3W only with the consent of a parent or legal guardian, who must agree to these Terms on your behalf and is responsible for your use of the Service, including any purchases.

If you use Vi3W on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it. In that case, “you” includes that organisation.

You may not use the Service if you are barred from doing so under applicable law.

4.Creating and maintaining an account#

To use most features you need an Account. When you create one, you agree to give us accurate information and to keep it up to date.

Each Account is for one person. You may not share your Account, sell or transfer it, or create Accounts in order to get around limits, Credits or a suspension (see the Acceptable Use Policy).

5.Account security#

You are responsible for keeping your sign-in details secure and for activity that happens under your Account. Use a strong password, and do not share your login.

6.Using Vi3W#

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose, within the limits of your Plan.

You must follow the Acceptable Use Policy and any reasonable instructions we provide in the Service. Features, limits and Credit costs are described in the Service and on our pricing information, and may change as described in section 25.

7.AI-generated content#

Vi3W uses artificial intelligence to generate Outputs. AI is powerful but imperfect. Please understand the following before you rely on anything Vi3W generates:

• Outputs are not guaranteed to be accurate, complete, unique, error-free, or suitable for any particular purpose.
• Outputs may contain geometric errors, incorrect dimensions, non-manifold or non-printable geometry, missing parts, or other defects.
• Similar Inputs may produce different Outputs, and different users may receive similar or identical Outputs.
• We do not guarantee that Outputs are free from third-party intellectual property claims.

8.User content#

You are responsible for your Inputs and for how you use your Outputs. By submitting Inputs, you confirm that:

• you own them, or have all the rights, licences and permissions needed to submit them to Vi3W and to have them processed as described in these Terms;
• they do not infringe anyone’s intellectual property, privacy or other rights; and
• they comply with the Acceptable Use Policy and applicable law.

Do not upload personal data about other people, such as photographs of identifiable individuals, unless you have a lawful basis and any permission you need to do so.

We do not review all User Content, and we are not obliged to. We may, however, access, review, restrict or remove User Content where reasonably necessary, as described in the Privacy Policy and in section 26.

9.Ownership and intellectual property#

You keep ownership of your Inputs. Vi3W does not claim ownership of content you upload. Your ownership is subject to any rights that third parties already have in it.

We keep ownership of Vi3W. We, and our licensors, own all rights in the Service, including our software, website, web application, user interface, branding, logos, infrastructure, algorithms, models (where applicable), documentation, service design and other technology. Nothing in these Terms transfers any of these to you, except the limited right to use the Service described in section 6.

You may not use the Vi3W name, logo or branding without our prior written permission.

10.License granted to Vi3W#

To run the Service, we need your permission to handle your User Content. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit, transform, display and otherwise use your User Content, only as reasonably necessary to provide, operate, secure, maintain and improve the Service for you. This includes sending relevant Inputs to Third-Party Services, such as AI infrastructure providers, when that is needed to perform a generation you ask for.

This licence lets us sub-license these rights to the service providers who help us run Vi3W, only for those same purposes. It ends when your User Content is deleted from the Service, except for copies we must keep as described in the Privacy Policy.

AI training. We do not use your prompts, uploaded images, uploaded files or Generated Models to train general-purpose AI models without your explicit consent. If we ever introduce a programme that would do so, we will describe it clearly and ask for your consent separately.

We will not use your User Content in our marketing, such as a public showcase, without your permission.

11.Generated outputs#

As between you and Vi3W, and to the extent we have any rights in them, we assign to you our rights in the Outputs generated from your Inputs. You may use, modify, download, distribute and commercialise your Outputs, subject to:

• applicable law;
• the rights of third parties;
• your responsibility to have the rights needed for your Inputs;
• any limitations imposed by the underlying AI models or Third-Party Services used to create them; and
• these Terms, including the Acceptable Use Policy.

Because of how AI works, Outputs may not be unique, and other users may generate similar or identical results. The law on whether AI-generated works can be protected by copyright is unsettled and varies between countries. We cannot promise that you will be able to register or enforce intellectual property rights in an Output.

12.Third-party services#

Vi3W relies on Third-Party Services to work. At the moment these include Firebase (Google) for authentication, database and storage; Replicate and Tripo for AI model processing; Vercel for hosting; Vercel Web Analytics, PostHog, Mixpanel and Google Analytics for analytics; and Razorpay for payments and subscriptions. The Privacy Policy explains what data each one receives.

These providers operate under their own terms and policies. We choose them carefully, but we do not control them and are not responsible for their services, availability or practices, except as required by applicable law. We may change our providers over time.

13.Subscriptions#

Vi3W offers a free plan and paid Subscriptions. Each Plan sets its price, billing period (for example, monthly), Credit allowance and limits. The details of each Plan are shown in the Service before you buy.

Free plans and free Credits are offered at our discretion and may be limited, changed or withdrawn.

14.Billing and payments#

Payments are processed by Razorpay. When you pay, you also agree to Razorpay’s terms. Card and bank details are entered with and handled by Razorpay; we do not intentionally receive or store your full card number.

Prices are shown in the Service at checkout, together with any applicable taxes such as GST. You authorise us, through Razorpay, to charge the payment method you provide for the price of your Plan and applicable taxes on each billing date.

If a payment fails, we may retry it, pause paid features, or move your Account to the free plan. See the Refund & Cancellation Policy for details.

15.Automatic renewal#

In India, recurring payments are processed under the Reserve Bank of India’s e-mandate framework. Your bank or card issuer may notify you before a renewal is charged, and you can also manage the mandate with them.

If we change the price of your Plan, we will tell you in advance, and the new price will apply from your next billing period. You can cancel before then if you do not want to continue.

16.Credits#

Paid Plans include a set number of Credits each billing period. Using certain features uses up Credits; the cost of each action is shown in the Service.

• Credits are a service entitlement, not money. They have no cash value and are not stored value, a deposit or a payment instrument.
• Credits cannot be redeemed for cash or refunded, except where the law requires.
• Credits cannot be transferred between Accounts, sold or exchanged.
• If a payment fails, we do not issue the Credits that would have come with that payment.

17.Credit expiration#

Credits issued at different times expire at different times, each 30 days from its own issue date. Your remaining Credits and when they expire are shown in the Service.

18.Cancellation#

You can cancel automatic renewal at any time from your account settings in the Service.

Cancelling stops future renewals. It does not end your current billing period: you keep access to your paid Plan until the end of the period you have already paid for, after which your Account moves to the free plan. Credits you already have continue to follow the 30-day expiry rule.

Cancelling is not the same as getting a refund. See the next section.

19.Refunds#

Subscriptions are generally non-refundable, except where a refund is required by applicable law, required by the payment provider, or given by us at our discretion (for example, for a duplicate charge or a billing error on our side).

Nothing in these Terms takes away any refund right you have under applicable consumer protection law. The full policy, including duplicate and unauthorised charges, is in the Refund & Cancellation Policy.

20.Acceptable use#

You must use Vi3W lawfully and responsibly. The Acceptable Use Policy sets out the rules in full and forms part of these Terms.

21.Prohibited activities#

Among other things, you must not:

• use Vi3W for anything illegal, fraudulent or harmful;
• upload content you do not have the right to use, or that infringes others’ rights;
• generate or upload sexual content involving minors, content that sexually exploits anyone, or violent extremist content;
• attempt to break, probe or bypass our security, or attack or overload our infrastructure;
• scrape the Service, or automate access except through interfaces we provide for that purpose;
• get around Credit, plan or usage limits, including by creating multiple Accounts to collect free Credits;
• reverse engineer, copy or resell the Service, or use it to build a competing product, except as the law expressly permits.

22.Copyright and infringement#

We respect intellectual property rights. If you believe content on Vi3W infringes your copyright or other rights, email aman2002porwal@gmail.com with the details listed in the Content & Intellectual Property Policy. We may remove content and, for repeated infringement, suspend or close Accounts.

23.Service availability#

We work to keep Vi3W available and reliable, but we do not promise that it will be uninterrupted, error-free or always available. The Service may be unavailable because of maintenance, updates, failures at our Third-Party Services, or events outside our control. Generation times vary. Keep your own copies of important Outputs.

24.Beta and experimental features#

We may offer features marked as beta, preview, experimental or similar. These are provided to try out, may be less reliable, may change or be withdrawn at any time, and may have their own limits. Use them at your own risk.

25.Changes to Vi3W#

Vi3W is actively developed. We may add, change or remove features, and change prices, plans, Credit allowances, Credit costs and limits.

Where a change materially reduces what you have paid for, or where the law requires it, we will give you reasonable advance notice. Price changes to an active Subscription apply from your next billing period, as described in section 15.

26.Suspension and termination#

We may restrict, suspend or close your Account, or remove User Content, if we reasonably believe that you have broken these Terms or the Acceptable Use Policy, that your use creates a legal, security or fraud risk, or that we are required to do so by law.

Where reasonable and lawful, we will tell you why and give you a chance to respond. We may act without notice in serious cases, such as illegal content, fraud or a threat to the security of the Service or other users.

If we close your Account for a serious breach, you will not be entitled to a refund of fees or Credits, except where the law requires one. If we close your Account for reasons that are not your fault, such as discontinuing the Service, we will offer a fair pro-rata refund of prepaid fees for the unused period.

27.Account deletion#

You can delete your Account at any time from the account menu in the app (your profile, top right, then Delete account). Before you do, cancel any active Subscription and download any Outputs you want to keep.

Deleting your Account permanently deletes your projects and Generated Models, and any unused Credits are forfeited. Some information may be kept for a limited time for legal, security, fraud-prevention or operational reasons, as explained in the Privacy Policy.

28.Disclaimers#

To the maximum extent permitted by law, the Service and all Outputs are provided “as is” and “as available”. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

Some jurisdictions do not allow certain warranties to be excluded. In those places, the exclusions above apply only to the extent the law allows, and your statutory rights are not affected.

29.Limitation of liability#

To the maximum extent permitted by law:

• we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or related to the Service or any Output; and
• our total liability for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) ₹1,000.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

30.Indemnification#

To the extent permitted by law, you agree to indemnify and hold harmless Vi3W from claims, losses and reasonable costs (including legal fees) brought by a third party that arise from your User Content, your use of Outputs, or your breach of these Terms or applicable law. We will tell you about any such claim promptly and let you take part in its defence.

31.Governing law#

These Terms are governed by the laws of India. If you use Vi3W as a consumer and live elsewhere, you keep any protection that the mandatory laws of your country of residence give you.

32.Dispute resolution#

If you have a problem with Vi3W, please contact us first at aman2002porwal@gmail.com. Most issues can be resolved quickly and informally, and we will try in good faith to do so.

If we cannot resolve a dispute within 30 days, it may be brought before the courts at Pune, Maharashtra, which will have jurisdiction, without prejudice to any right you have as a consumer to bring proceedings in your place of residence or before a consumer commission.

33.Changes to these Terms#

We may update these Terms from time to time. The date at the top of this page shows when they last changed.

If a change is material, we will tell you in advance by email or in the Service, and where required we will ask you to accept the new Terms. Changes do not apply to disputes that arose before the change. If you do not agree with a change, you can stop using Vi3W and delete your Account.
